香港職工會聯盟(職工盟)對菲律賓反恐法聲明

香港職工會聯盟(職工盟)關注菲律賓總統杜特爾特於2020年7月3日在菲律賓簽署2020年《反恐怖主義法》(《反恐法》)。《反恐法》成立並容許反恐委員會指定個人和團體為恐怖分子、將長達24天的拘留合法化而無須任何逮捕令或檢控、授權警察和軍隊實施甚至延長監控,並刪除自動補償不當拘留的法律條款。

這些規定加上杜特爾特任總統期間的27,000多宗法外處決,引起了本地和國際層面的公眾、專家和組織擔憂。他們擔心《反恐法》僅出於政治目的而任意逮捕和侵犯公民自由,甚或進一步被濫用。職工盟重申,即使公共安全受到真正威脅及值得保障,人權、法治和正當程序無論從普遍意義上還是經1987年憲法本地化而言,都不應讓路予打擊全由政府定義的恐怖主義。

許多當地人權倡導和工會組織已在法院提起請願書覆核《反恐法》。職工盟深深敬佩菲律賓包括工會在內的民間社會,在《反恐法》的陰霾中仍致力捍衛公民和勞工權利。
作為香港公民社會的一員,職工盟以團結精神表達,對於以鞏固國家安全為名而剝奪公民權利的關注。職工盟重申支持菲律賓工人和工會,並會加強與之在此議題上的相互交流。

職工盟要求對該法得到透徹審查及明確修訂,以顯示和對政治和公民權利的保護。職工盟將向菲律賓政府請願,要求尊重普世價值和本地社會的建言。

 

RESOLUTION TO SUPPORT CAMPAIGNS OF TRADE UNIONS IN THE PHILIPPINES AGAINST THE ANTI-TERRORISM ACT OF 2020

Presented by: Hong Kong Confederation of Trade Unions
Aware of the signature of President Duterte on the Anti-Terrorism Act of 2020 in the Philippines on 3 July 2020, which establishes and enables a council to designate individuals and groups as terrorists, legitimises detainment of up to 24 days without warrant or charge, authorises police and military to impose and extend surveillance, and removes the legal clauses to automatically compensate for wrongful detention;

WHEREAS, worries from the public, experts and organisations, both local and international, over arbitrary arrests and violation of civil liberties arising from the Act are constantly disregarded;

WHEREAS, more than 27,000 extrajudicial killings during the presidency of Duterte hint at the potential abuse of the Act for merely political purposes;

WHEREAS, a petition case has been filed by numerous human rights advocates and trade unions in court to review on the Act;

WHEREAS, the concern over deprivation of civil rights for consolidating national security is shared by the civil society of Hong Kong in solidarity;

The Standing Committee of Hong Kong Confederation of Trade Unions (HKCTU):
Reaffirms that human rights, rule of law and due process, both in universal terms and as localised in the Philippines with 1987 Constitution, should never give in to combating terrorism, content of which are determined by the government, even though public safety is under genuine threat and deserve protection;

Expresses its appreciation to the commitment of the civil society, including the trade unions, in the Philippines to defending the civil and labour rights amidst the Act;
Requests thorough review on and expressive amendments to the Act so that protection of political and civil rights is specified and enhanced;

Therefore be it:
RESOLVED, that HKCTU reiterates its support to and intensifies exchanges with the workers and unions in the Philippines about the issue;
RESOLVED, that HKCTU petitions the government of the Philippines for respect on the universal values and the advice from the local society.
