保安局局長李家超於本月19日發表文章, 要求議員通過政府上月提交的「2020年入境(修訂)條例草案」, 提出將大譚峽懲教所變為新的羈留設施. 文章中把被羈留者形容為十惡不赦的罪犯, 形容新增的160個羈留額能「讓政府有效處理困擾多年的免遣返聲請問題」。(Please scroll down for English)
The HKSAR government proposes to build one more immigration detention centre; The CIC Detainees’ Rigjts Concern Group is worried.
The director of the security bureau, Mr. Lee Ka Chiu posted on the government website on 19/01/2021 in Chinese only. He urged legislators to pass the “Immigration (Amendment) Bill 2020″. The Amendment includes provision for the establishment of a new detention centre in Tai Tam Gap. In the article, Mr. Lee described the detainees as criminals responsible for unforgivable crimes, and claimed that the 160 extra detention quota thus created, would “effectively solve the non-refoulement claim problem, which has troubled the government for many years”.
The non-refoulement claims are humane measures to protect people who are prosecuted in their home country, the claimants are not the “problem”. The problem in Hong Kong is the extraordinarily long time it takes to process each claim. People have to wait for years, while not given the right to work. It also means endless detention for those whose claims are not allowed at first and who have a right to appeal.
It is extraordinary that the government believes more detention centres will solve the issue of long delays in processing the non-refoulement claims. Not only is it not solving the problem, but it is actually creating more human rights problems and suffering, and also an enormous waste of public money.
Our concern group suggests that the government, instead of wasting public money on building detention centres, should put resources into improving the non-refoulement claim process to make it swifter and just, in order to help the persecuted people live their life of freedom and dignity.
